Terms of Service
These terms govern your use of mysite-name's photography services across England. Please read them carefully before booking any sessions to ensure a clear understanding of our photographic approach, client responsibilities, and the service delivery process.
1. Service Agreement
By booking our photography services—whether through online bookings, email enquiries, or verbal agreements—you agree to these terms. Our photography services operate in compliance with relevant UK creative industry standards and copyright legislation.
We provide professional photography services through our qualified photographer across England, offering portrait, event, wedding, and commercial photography.
2. Service Scope and Photographic Standards
Our services include photographic sessions, image editing, digital delivery, and print products. We focus on providing quality photography using professional equipment and established photographic techniques.
While we deliver work to professional standards, photographic outcomes can be influenced by weather conditions, location factors, subject cooperation, and technical variables. We use our experience and expertise to achieve quality results within given conditions.
3. Client Responsibilities
To ensure successful session outcomes, clients agree to:
- Arrive punctually for scheduled sessions
- Communicate any specific requirements or concerns
- Ensure subjects are prepared and appropriately dressed
- Provide safe and accessible location access
- Adhere to agreed payment schedules
Client cooperation and communication significantly influence session progress and final results.
4. Session Planning and Preparation
Our photographer will discuss session requirements and provide guidance on preparation. We establish clear expectations regarding timing, locations, and deliverables during the planning process.
We reserve the right to decline sessions that involve unsafe conditions, inappropriate content, or requirements beyond our equipment capabilities.
5. Booking and Session Confirmation
Session proposals are provided based on initial discussions and are valid for 14 days. Session confirmation requires written acceptance of the proposal and payment of any required deposit. Photography work is scheduled once confirmation is received.
Significant changes to session requirements after confirmation may affect pricing and scheduling, which will be communicated and approved before proceeding.
6. Session Timing and Duration
Session durations are estimates based on typical requirements and the information you provide. Actual session length may vary due to weather conditions, subject cooperation, or unforeseen circumstances at the location.
We allocate sufficient time for each session while maintaining flexibility to accommodate natural moments and client needs as they arise.
7. Payment Terms
Payment schedules are outlined in session proposals. For sessions exceeding £300, we typically require a 50% deposit before scheduling, with the balance due before image delivery. Package purchases require full payment according to the agreed terms.
Late payments may affect image delivery timelines. We reserve the right to withhold digital files and products until outstanding payments are received.
8. Image Delivery and Editing
We deliver professionally edited images within the timeframe specified in your agreement. Our editing includes colour correction, exposure adjustment, and basic retouching. Additional extensive editing may be available at extra cost.
We select the best images from your session based on technical quality and emotional impact. The number of delivered images depends on session duration and package selected.
9. Copyright and Usage Rights
The photographer retains copyright of all images. Upon full payment, clients receive a license to use the images for personal use. Commercial usage requires additional licensing, which will be discussed and agreed separately.
We retain the right to use images for portfolio, marketing, and competition purposes unless specifically agreed otherwise in writing before the session.
10. Client Cooperation and Conduct
Clients are responsible for the conduct of all session participants. We reserve the right to terminate sessions if participant behaviour becomes unsafe, inappropriate, or prevents the photographer from working effectively.
Session fees will not be refunded for terminated sessions due to client conduct issues.
11. Cancellation and Rescheduling
Sessions may be rescheduled without charge with 48 hours notice. Cancellations within 24 hours may incur a £50 charge. Same-day cancellations will be charged at 50% of the session fee.
We understand that circumstances change and will make reasonable efforts to accommodate rescheduling requests when possible.
12. Weather and External Factors
For outdoor sessions, we monitor weather conditions and will contact you if conditions appear unsuitable. We can reschedule or suggest alternative indoor locations if weather prevents successful outdoor photography.
We cannot be held responsible for weather conditions or other external factors that affect session timing or location options.
13. Liability Limitations
Our liability for services is limited to the session fee paid. We cannot accept responsibility for subjective satisfaction, preferred aesthetic outcomes, or results influenced by factors beyond our reasonable control.
We maintain appropriate professional equipment insurance and follow industry best practices in our photographic work.
14. Terms Modification
We reserve the right to update these terms periodically to reflect changes in our services, UK regulations, or industry practices. The current terms are always available on our website, and continued use of our services constitutes acceptance of any updates.
